These Website Terms explain how you may use Harbour Outdoor Living Limited's websites and online services. They are separate from our Terms & Conditions of Sale, which govern any Order for Products or Services. At checkout, the Website Terms continue to govern use of the website and checkout functionality, while the Terms & Conditions of Sale and the pre-contract information presented for the Order govern the purchase itself.


1. Who we are

1.1 This website is operated by Harbour Outdoor Living Limited ('Harbour', 'we', 'us' or 'our'), registered in England and Wales under company number 12934430. Our registered office and principal trading address is The Foaling Yard, Hope Hall Farm, Dullingham, CB8 9UW, United Kingdom.

2. Using our website

2.1 You may use our website for lawful personal and domestic purposes, including browsing our Products and Services, managing an Order or account and contacting us.

2.2 You must not use the website unlawfully, fraudulently or in a way that materially interferes with its operation, security or other users. In particular, you must not knowingly introduce malicious code; attempt unauthorised access to accounts, systems or data; circumvent security, access controls, purchase limits or promotional rules; impersonate another person; or use the website to facilitate fraud or other unlawful activity.

2.3 You must not systematically scrape, crawl, harvest, copy, download or extract website content or data using bots, automated tools or similar methods without our prior written permission, except where the activity cannot lawfully be restricted. This includes systematic extraction for building datasets, training or evaluating artificial-intelligence or machine-learning systems, commercial price or catalogue replication, or creating a competing database or service.

2.4 Nothing in these Terms prevents ordinary use of search engines or other services which index publicly accessible pages in accordance with applicable law and generally accepted technical controls, or any use which we expressly authorise.


3. Accounts and security

3.1 If you create or use an account, you must provide accurate information, keep your login credentials reasonably secure and tell us promptly if you believe your account or credentials have been compromised.

3.2 You are responsible for activity carried out through your account to the extent it results from your failure to take reasonable steps to keep credentials secure. This does not make you responsible for activity caused by our security failure or matters outside your reasonable control.

3.3 We may temporarily restrict access to an account where reasonably necessary to protect you, us or others, investigate suspected fraud or security incidents, or comply with law. Where appropriate, we will take reasonable steps to help a genuine account holder restore access.


4. Intellectual property

4.1 The website and its text, photographs, graphics, videos, product information, designs, logos, software and other content are owned by us, licensed to us or otherwise used with permission and are protected by intellectual-property laws.

4.2 You may view, download or print reasonable extracts for your personal, non-commercial use. You must not reproduce, republish, sell, license, commercially exploit, remove ownership notices from, or create a substantial database from our content without permission, except where law allows it.

4.3 Harbour names, logos and other branding must not be used in a way that falsely suggests endorsement, affiliation or approval.


5. Reviews and content you provide

5.1 If you submit a review, photograph, video, comment or other material for publication on our website or social channels, you must have the right to provide it and it must not be unlawful, knowingly false, defamatory, threatening, abusive, infringing, fraudulent or contain another person's personal information without an appropriate basis for sharing it.

5.2 Where you deliberately submit content for publication, you give us a non-exclusive, worldwide, royalty-free licence to host, reproduce, format and display that content for the purpose for which it was submitted and to operate, moderate and promote the relevant Harbour service or channel. You keep ownership of your content.

5.3 We may moderate or remove published user content where we reasonably believe it breaches these Terms, the law or applicable platform rules. We will not suppress or manipulate genuine reviews merely because they are negative.

5.4 Content supplied privately to administer an Order, Delivery, complaint, return, warranty claim, safety issue or other customer-service matter is different from content submitted for publication. We may use that material to investigate, administer and resolve the matter and for legitimate internal purposes described in our Privacy Notice, but we will not treat supplying it as permission to use it in advertising or promotional material.


6. Product information, prices and transactions

6.1 We take reasonable care over information on the website, but website content is general information and may change. Product images can be affected by photography, lighting and screen settings, and stock, specifications, prices and availability may change.

6.2 An expected stock or inbound date is an estimate of when we expect the Product to become available to us; it is not a confirmed customer Delivery date unless expressly stated otherwise.

6.3 Prices, mandatory charges and promotional information presented as part of a purchase must be read together with the relevant offer and checkout information. If you place an Order, the formation and performance of the Contract are governed by our Terms & Conditions of Sale and the pre-contract information supplied for that Order.

6.4 Nothing in these Website Terms allows us to rely on an inaccurate or misleading statement where consumer law provides otherwise.

 

7. Promotions, misuse and obvious errors

7.1 Promotional offers are subject to their stated eligibility, product, timing and usage conditions. You must not deliberately manipulate, interfere with, bypass or exploit our website, checkout, URLs, product or variant identifiers, APIs, scripts, accounts, promotional codes, pricing logic, delivery options, stock controls, purchase limits or other technical functionality in order to obtain a Product, Service, discount, refund, credit, promotional item, Delivery service or other financial or commercial benefit which you know, or ought reasonably to know, you are not entitled to receive.

7.2 This includes exploiting an obvious error, vulnerability, unintended website behaviour or technical configuration; altering or constructing URLs or requests; bypassing the normal customer journey or eligibility controls; manipulating product, variant, basket or checkout data; creating or using multiple accounts to circumvent restrictions; or combining promotions or functionality in a way which you know, or ought reasonably to know, is unintended.

7.3 Discovering or encountering an error does not itself breach these Terms. If you believe you have identified a vulnerability, pricing error or other unintended behaviour, you should report it to us and must not knowingly exploit it for financial or other gain.

7.4 Where we reasonably believe that the website, checkout or an Order has been deliberately manipulated, abused or exploited, we may investigate and take proportionate steps to protect our systems, customers and business. These may include restricting relevant account or website access, withholding acceptance of an Order, withdrawing an improperly obtained benefit where lawful, and seeking recovery of property or losses where we have a lawful right to do so.

7.5 The contractual consequences for an Order, including whether an Order has been accepted, are governed by our Terms & Conditions of Sale. Nothing in this section removes or restricts statutory consumer rights or gives us a general right to cancel an otherwise valid Contract merely because it is commercially unattractive.

 

8. Links and third-party services

8.1 Our website may link to or integrate services operated by other organisations, such as payment, finance, delivery, review, social-media or mapping providers. A link or integration does not mean we control or endorse everything on that service.

8.2 Third-party services may have their own terms and privacy information. We are not responsible for the independent operation or content of a third-party service, but this does not exclude responsibility which the law places on us for services we have agreed to provide or for persons acting on our behalf.

 

9. Website availability and security

9.1 We aim to keep the website available and secure but do not promise uninterrupted or error-free access. We may reasonably suspend, withdraw, maintain or change all or part of the website, including to address security, technical or legal issues.

9.2 We are not responsible for loss caused solely by temporary website unavailability or a matter outside our reasonable control where that loss was not reasonably foreseeable, but nothing in these Terms excludes liability which cannot lawfully be excluded or restricts rights arising from a Contract with us.

9.3 You should use appropriate security protections on your own device and network. If you discover a suspected security vulnerability affecting our website, please report it to us rather than exploiting it or accessing data unnecessarily.

 

10. Accessibility

10.1 We want our website and online information to be reasonably accessible. If you have difficulty accessing information or completing an online process, contact Customer Services and we will take reasonable steps to provide an appropriate alternative or additional support.

 

11. Privacy and cookies

11.1 Our Privacy Notice explains how we use personal information. Our Cookie & Tracking Notice and live cookie settings explain our use of cookies and other storage or access technologies and the choices available to you.

11.2 Where consent is legally required for optional cookies or other storage or access technologies, those technologies are not used until the required consent has been obtained. You can change available choices using our website controls. Acceptance of these Website Terms or our Terms & Conditions of Sale is not consent to optional tracking or marketing.

11.3 These Website Terms do not replace or reduce any right you have under data-protection or electronic-communications law.

 

12. Restricting misuse

12.1 Where we reasonably believe the website, an account or an online service is being used unlawfully, fraudulently, insecurely or in material breach of these Terms, we may take proportionate steps to protect our systems, customers and business, including restricting the relevant access while we investigate.

12.2 We will not use this provision simply to prevent a customer from making a complaint, exercising statutory rights, leaving a genuine review or contacting a regulator or dispute-resolution body.

 

13. Liability

13.1 Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or statutory consumer rights.

13.2 If you are a consumer, we are responsible for loss or damage caused by our breach of these Website Terms where it was reasonably foreseeable. We are not responsible for remote or unforeseeable loss or for business losses arising from use of a consumer website for an undisclosed commercial purpose.

13.3 Liability connected with a Product, Service, Delivery, Installation, refund or other Contract with us is governed by the Terms & Conditions of Sale and applicable law rather than being reduced by these Website Terms.

 

14. Changes to these Website Terms

14.1 We may update these Website Terms to reflect changes to the website, our services, technology or law. The current version will be published on the website with its effective or update date.

14.2 A change to these Website Terms does not retrospectively change the Terms & Conditions of Sale governing an Order already accepted.

 

15. Other important terms

15.1 If a provision of these Terms is unlawful or unenforceable, the remaining provisions continue in effect. A delay in enforcing a right does not waive it.

15.2 These Terms are intended to operate alongside our Terms & Conditions of Sale, Privacy Notice, Cookie & Tracking Notice, Delivery & Installation Policy, Product Guarantee information and any specific terms clearly presented for a particular online feature, promotion or Order.
